This Criminal Miscellaneous Petition has been filed for cancellation of bail granted to the accused on 15.02.2021 in Crl.O.P.No.71 of 2021 in Crime No.4 of 2021.
2. The leaned counsel for the petitioner would submit that the fourth respondent/accused was granted bail in Crl.O.P.No.7 of 2021 and one of the condition imposed by this court on granting the bail was that the accused should not threaten the witness. However, the fourth respondent herein had threatened the petitioner and the present petition has been filed seeking for cancellation of bail.
3. The fourth respondent has filed a Counter-affidavit denying the allegations and submitted that in a similar manner the petitioner herein had made allegations against the accused and also filed an application seeking for police protection. He would submit that an enquiry was conducted by the respondent police and it was found that the allegations made by the petitioner are not true. Therefore, the respondent
police had closed the enquiry.
4. Mr.Vinoth Raja, learned Government Advocate (Crl.side) was directed to get a report from the first respondent police with regard to the alleged complaint made by the petitioner.
5. Today when the matter is taken up hearing, the learned Government Advocate (Crl.side) would submit that based on the complaint given by the petitioner, an enquiry was conducted and it was found that the allegations are not true.
6. Further, Mr.A.Kalaiselvan, learned counsel for the accused submitted that accused has not threatened the petitioner. However, he would also submit that the accused undertakes that he will not interfere or disturb the petitioner herein.
7. Recording the said submissions made, this Criminal Miscellaneous Petition is dismissed.
