Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus directing the respondent to conduct survey for demarcation of the boundaries and grant separate patta in respect of 91⁄2 cents in R.S.No.38/17 and 61⁄2 cents in R.S.No.38/18 of Parigam Village, Chinna Salem Taluk, Villpuram District by considering the petitioner's applications dated 10.01.2018.

Mr.S.Soundararajan, learned Government Advocate takes notice for the respondent. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

The petitioner seeks for a Mandamus directing the respondent to conduct survey for demarcation of the boundaries and grant separate patta in respect of 91⁄2 cents in R.S.No.38/17 and 61⁄2 cents in R.S.No.38/18 of Parigam Village, Chinna Salem Taluk, Villpuram District by considering his application dated 10.01.2018.

4. The grievance of the petitioner is that the said request has not been considered so far. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the respondent to consider and decide the same on merits and in accordance with law. Thus, this writ petition is disposed of by directing the respondent to consider the representation of the petitioner dated 10.01.2018 and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
