Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or any other appropriate order or direction in the nature of Writ, directing 1st Respondent to consider the representation of the Petitioner dated 10.02.2023 to allot shop spaces in metro station in chennai or alternatively pay a compensation of Rs.50,00,000/- and pass speaking order within a period fixed by this Court.

ORDER

This Writ Petition has been filed for a direction to the 1st Respondent to consider the petitioner's representation dated 10.02.2023 seeking allotment of spaces for running shops in Metro Station, Chennai.

2. The petitioner was running two shops in the name and style M/s Variety Centre at Plot No. C-20, II and Avenue, Anna Nagar, Chennai-40 by way of a lease deed dated 01.12.2011. It is the case of the petitioner that the above said shops were taken over by CMRL, the 1st respondent for construction of Metro Rail, for which, the petitioner was paid with some compensation amount. Being not satisfied with the compensation amount,

the petitioner made a representation dated 10.02.2023 to the respondents seeking allotment of spaces for running shops within the premises of Metro Rail. However, the said representation is still pending. Hence, this Writ Petition has been filed.

Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court issues a direction to the 1st Respondent to consider the representation dated 10.02.2023 made by the petitioner seeking allotment of spaces for running shops in Chennai Metro Station and pass orders on merits within the time that may be stipulated by this Court.

In view of the limited relief sought for by the petitioner, this Court without going into the merits of the case, directs the respondent to consider the petitioner's representation dated 10.02.2023 seeking allotment of spaces for running shops in Chennai Metro Station and pass appropriate orders in accordance with law within a period of four weeks from the date receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioner.

5. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. 20.06.2023 Index : Yes / No Internet : Yes / No NHS To
