This petition has been filed to modify the condition imposed on the petitioner that he shall pay a sum of Rs.25,000/- to the account of children and the defacto complainant on or before 10th of every English calender month and directed to pay nominal school fees to the children, but not execeeding Rs.50,000/- per child until modified in the above Crl.O.P.No.4960 of 2023 dated 27.04.2023.

The learned counsel for the petitioner submitted that there was an email by the defacto complainant to the school authorities stating that she has got a new job and shifting to Bangalore along with children, however, the petitioner is also duty bound to maintain his parents. He would submit that the petitioner is earning a sum of Rs.89,000/- out of which he is paying school fees to the children, the petitioner finds it difficult to bear all the expenses and also to manage himself and his parents. Hence, the present petition has been filed to modify the condition.

Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable one, this Court is inclined to modify the condition that the petitioner shall deposit the sum of Rs.20,000/- (Rupees twenty thousand only) per month to the account of children and the defacto complainant on or before 10th of every English calendar month until it is modified from the date of receipt of copy of this order. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No.4960 of 2023 vide order dated 27.04.2023 shall remain unalterted. 20.07.2023 rpp 2/3
