Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the first Respondent to deal with his appeal in case No.7508/2012 in accordance with law and conduct the proceedings by affording opportunity of personal hearings of the parties to the proceedings on his complaint dated 31.08.2012. O R D E R

The prayer in the writ petition is for issuance of writ of mandamus directing the first respondent to deal with the petitioner's appeal in case No.7508 of 2012 in accordance with law and conduct the proceeding by affording opportunity of personal hearings of the parties to the proceeding on his complaint dated 31.08.2012.

2. The petitioner had filed an appeal petition before the first respondent on 31.08.2012 in appeal no.7508 of 2012 complaining about the conduct of the second respondent, which is pending. The grievance of the petitioner is that though he has preferred this appeal on 31.08.2012 no final order have been passed on the same. Hence he has sought for a direction to the first respondent to conclude the appeal expeditiously. https://hcservices.ecourts.gov.in/hcservices/

3. In view of the limited prayer sought for and without going into the merits of the averments made in the affidavit, there shall be a direction to the first respondent to consider the appeal and pass orders on its own merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.

4. With the above observations, the writ petition is disposed of. No costs. Consequently miscellaneous petition are also closed.
