ORDER

This petition has been filed to direct the 1st respondent not to harass the petitioner and investigate the complaint in proper manner.

2. The contention of the petitioner is that the petitioner earlier was a tenant under one Mohandass and Jayakumari. During the tenancy period, by entering an agreement on 25.02.2021, the petitioner had given a loan amount of Rs.11 lakhs to the landlord. Suppressing the same, the landlord Jayakumari had given a false complaint stating that the petitioner had taken a loan from her for a sum of Rs.5 lakhs and 45 sovereign of jewels for his business purpose. This false complaint has been given only to escape from the loan liability towards the petitioner.

3. The learned Government Advocate (Crl.Side) has submitted that on the complaint of one Mohandass and Jayakumari, a complaint in C.No.247 of 2021 was received. Thereafter, enquiry was conducted and the petitioner was summoned and he appeared on 03.08.2021 and produced documents and gave his explanation.

4. Considering the petitioner's claim and rival claim by the counter petitioner, this Court is of the view that the appearance of the petitioner is necessary for further enquiry. Hence, the petitioner is directed to appear before the respondent Police on 15.09.2021 and the respondent police shall continue their enquiry in accordance with law.

5. With the above directions, this Criminal Original Petition is disposed of.
