Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to consider the representation of the petitioners dated 26.02.2016 for issuance of patta in the light of the recommendation of the respondent herein in proceedings No.177/2015, dated 06.02.2015 for the property conveyed to the petitioners under the registered sale deed document No.804 of 2006 dated 27.04.2006 with the Sub Registrar, Saidapet and consequently direct the respondent to issue patta in the name of the petitioners within a time frame to be fixed by this Hon'ble Court. By consent, the writ petition is taken up for final disposal.
2.The petitioners claim to have purchased vacant house-site in Plot No.Shop Site, III, Millennium Town, Survey No.76, Adayalampattu Village, Ambattur Taluk, Tiruvallur District vide registered sale deed dated 27.04.2006 from Chennai Metropolitan Co-operative Housing Society Limited and it was also registered in the office of the Sub-Registrar, Saidapet and Ambattur and claim to be in possession and enjoyment of the same. petitioners thereafter approached the respondent for issuance of patta and the respondent has also conducted enquiry based upon the document and vide proceedings dated 06.02.2015, also made positive recommendation for sub-division of the survey number and for issuance of patta, but thereafter, no order has been passed and therefore, the petitioner has approached this Court by way of this writ petition.
3.Heard the submissions of the learned counsel appearing for the petitioners and Mr.R.A.S.Senthilvel, learned Additional Government Pleader, who accepts notice on behalf of the respondent.
4.Though the petitioner prayed for a larger relief, this Court in the light of the above facts and circumstances, directs the respondent to consider and dispose of the petitioners representation dated 26.02.2016 in the light of the recommendation vide proceedings No.177/2015, dated 06.02.2015, in accordance with law and pass orders, within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioners. 5.The writ petition is disposed of accordingly.
