Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure praying to direct the respondent to register a case on the petitioners' complaint dated 16.08.2016 under C.S.R.No.141/2016 pending on the file of the 1st respondent and to investigate it and to take immediate and stern action against the accused persons.

ORDER

This criminal original petition has been filed seeking a direction to the respondents to register a case on the petitioners' complaint dated 16.08.2016 under C.S.R.No.141/2016 pending on the file of the 1st respondent and to investigate it and to take immediate and stern action against the accused persons.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the respondents.

3. It is seen that the petitioners sent a complaint dated 16.08.2016 to the Superintendent of Police and not to the jurisdictional police station.

4. Under such circumstances, the petitioners are directed to appear in person before the second respondent police along with this order and lodge a fresh complaint, containing the very same contents as stated in the previous complaint dated 16.08.2016. On receipt of such complaint, the same shall be enquired into and action be taken thereon in accordance with law, if it discloses the commission of a cognizable offence or drop action otherwise.

With the above direction, this Criminal Original Petition is disposed of.
