ORDER

(Order of the Court was made by S.M.Subramaniam J.) Contempt Petition has been instituted to punish the respondents for their willful disobedience of the orders of this Court dated 03.11.2023 in W.A.No.3022 of 2023.

2. Para 5 of the order reads as follows:

"5. We are not issuing a specific timeline, however, it is expected that when surplus water is entering the land of the agriculturist, the Government shall take effective steps. We hope and trust that the Government will take up the issue and may take a decision upon the administrative sanction expeditiously and if possible, within a period of six months."

3. Learned Special Government Pleader based on the instructions, made a submission that Government issued G.O.(2D).No.258, Water Resources (WR2) Department, dated 06.12.2023, and sanctioned funds for construction of tank at Veppamkuppam. However, process is under progress.

4. It is a policy decision of the Government. Since funds are sanctioned, authorities have to take appropriate action to fulfill the needs of the people of that locality. That being the position, this Court does not find any willful disobedience of the orders of this Court.

5. Since funds have been sanctioned, respondents shall ensure construction of tank as expeditiously as possible. Accordingly, the contempt petition is closed. No costs.
