Mr.C.Selvaraj, learned Panel Advocate accepts notice for the respondent and is armed with instructions to enable a final disposal of this Writ Petition, even at the stage of admission. To be noted, there are no written instructions and he conveys the oral instructions received from the respondent, Regional Manager, Tamil Nadu Civil Supplies Corporation, Vellore.
2. The petitioner claims to have cultivated certain parcels of land in Nemili Taluk, Ranipet District and had offered the produce therefrom for procurement under the Public Distribution System to the sole respondent. The procurement was on direct purchase basis. On 10.07.2021, 226 bags of paddy were procured from the petitioner. The purchase bill for an amount of Rs.1,77,003.20 is also placed at page 21 of the typed set.
3. According to the petitioner, the above amount is outstanding since the date of purchase and despite several requests, the amount is not yet settled. He has also made several representations seeking settlement of the amount outstanding or return of the paddy.
4. On 10.04.2024, the petitioner has received a reply where the respondent seeks production of various documents in support of the claim. According to the petitioner, those documents have been handed over to the respondent, to no avail. Hence, this Writ Petition seeking a mandamus directing the respondent to consider the representation of the petitioner and settle the outstanding amount expeditiously.
5. The procurement of paddy from the petitioner as well as the amount outstanding is not in dispute and Mr.Selvaraj would confirm this position. Thus, in order to facilitate quick resolution of the matter, the petitioner will appear before the respondent on 28.06.2024 at 12.00 noon without awaiting any further
notice in this regard along with one more copy of all documents in respect of his claim. The respondent shall grant audience to the petitioner and settle the amount due to him within a period of two (2) weeks from 28.06.2024.
6. This Writ Petition is allowed. No costs.
