PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd and 3rd respondents to deposit the entire compensation in respect of survey No.270/4 to an extent of 1.46 acres in Paruvai Village, Palladam Taluk, Tiruppur District before the 1st respondent in file No.Na.Ka.No.341/2026/A3 and further direct the 1st respondent to conclude the enquiry in an expeditious manner. ORDER
This is a petition filed by the petitioner seeking a direction to respondents 2 and 3 to deposit the entire compensation in respect of survey No.270/4 measuring 1.46 acres in Paruvai Village, Palladam Taluk, Tiruppur District before the first respondent in THE file namely Na.Ka.No.341/2026/A3 and further direct the first respondent to conclude the enquiry in an expeditious manner.
2. Heard the learned counsel for the petitioner and the learned Government Advocate accepting notice for respondents 1 to 3. Since no adverse orders is being passed, notice to the fourth respondent is dispensed with and the writ petition itself is taken up for final disposal.
3. The case of the petitioner is as follows:
(i) The subject property belongs to the petitioner and her husband. She acquired it by way of a sale deed. The fourth respondent is her second son. During 2020, he made a request to the petitioner to settle the subject property in his favour on the ground that it was required for expansion of textile business. Being carried away by what the fourth respondent said, the petitioner executed a settlement deed dated 05.6.2020 in his favour and it was registered as doc.No.4532 of 2020 on the file of the SubRegistrar, Sulur. (ii) After getting the settlement deed executed in his favour, the fourth respondent failed to take care of the petitioner. Rather, when the petitioner demanded money from him, he beat her. Hence, the petitioner filed a complaint before the first respondent
and it was taken on file in Na.Ka.No.341/2026/A3 dated 12.3.2026, in which, summons were issued for appearance and enquiry. (iii) In the meantime, certain lands including the subject property were acquired by respondents 2 and 3 for a defence industrial park and the compensation is likely to be granted to the fourth respondent. Hence, the petitioner submitted an application before the third respondent. The petitioner apprehends that in the event of disbursing the compensation amount in favour of the fourth respondent, she will be put to irreparable hardship. Hence the writ petition.
4. This Court has carefully considered the submissions of the learned counsel on either side and perused the materials available on record.

It is evident from the typed set of papers enclosed along with the affidavit filed in support of the writ petition that the petitioner already sent a representation dated 24.2.2026 to the first respondent seeking to cancel the said settlement deed dated 05.6.2020 under the Maintenance and Welfare of Parents and Senior
Citizens Act, 2007. Further, an enquiry has been contemplated before the first respondent pursuant to the representation of the petitioner dated 12.1.2026. The petitioner also sent a legal notice dated 05.3.2026 to the Executive Director of the Tamil Nadu Industrial Development Corporation Limited, based on which, it was informed to the second respondent that the petitioner made a request to withhold or deposit the compensation amount before the Maintenance Tribunal. Hence, it has also come to light that only after completion of the enquiry before the first respondent, the question of disbursement of the compensation amount will arise.

In the light of the above, the writ petition is disposed of with a direction to the first respondent to conclude the enquiry and after providing an opportunity of hearing to the fourth respondent, pass appropriate orders thereon on merits and in accordance with law and also communicate the outcome to all concerned within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected WMP is closed. 03-06-2026
