CMP No.14040 of 2025 in AS SR No.36227 of 2024 C.V.KARTHIKEYAN, J.

and K.RAJASEKAR, J.

(Order of the Court was made by C.V.Karthikeyan, J.) This petition has been filed seeking to condone the delay of 182 days in filing the above appeal in AS SR No.36227 of 2024.

2.The defendants are the appellants. Suit had been filed seeking recovery of possession. It is stated that in parallel proceedings, the matter had travelled upto the Hon'ble Supreme Court, wherein, the Supreme Court had directed the parties to mediate and directed them that they should maintain status quo.

3.It would only be appropriate that the issues are examined and that could be done only when the appeal is taken on file. Notice had been directed to the respondent and the learned counsel had entered appearance on behalf of the respondent.

4.We would condone the delay in filing the appeal. But however, hear the appeal before any interim orders are passed in the appeal suit. The petition stands allowed. Registry is directed to number the appeal, if it is otherwise in order and list the appeal for admission. Registry may also print the name of the counsel for the respondent in the cause list when the appeal is posted for admission.
