C.M.P.No.14367 of 2023 in C.M.A.SR.No.74905 of 2023 SUNDER MOHAN,J.

This Petition has been filed seeking to condone the delay of 201 days in filing the above captioned C.M.A.

2.Learned counsel appearing for the petitioner would submit that the 3rd respondent remained ex-parte before the Tribunal and he has made an endorsement to dispense with the notice to the 3rd respondent. 3.Though notice to the 1st respondent has been served and her name is also printed in the cause list, none entered appearance on behalf of the 1st respondent. After filing the present appeal, the 2nd respondent, the husband of the 1st respondent died and the 1st respondent is the only legal heir of the 2nd respondent and the learned counsel for the appellant has filed memo to that effect. 4.Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned. Hence, this petition is ordered as prayed for.

5.Registry is directed to number the C.M.A., if it is otherwise in order and list the same in due course.
