Petitioner/wife, who is presently residing in Coimbatore, has come up with this Transfer Civil Miscellaneous Petition, seeking to withdraw the Divorce proceedings in H.M.O.P.No.35 of 2018 pending on the file of the Sub-Court, Gudiyattam, Vellore District and transfer the same to the file of the Family Court at Coimbatore.

It is represented by the learned counsel for the Petitioner that, in spite of repeated efforts to contact the Petitioner, there is no response from her. In the Memo filed by the learned counsel for the Petitioner, it is stated that, the Petitioner did not turn up for mediation, though the Respondent expressed his readiness to live with the Petitioner.

The conduct of the Petitioner is not appreciated. As there is no proper communication from the Petitioner to her Advocate, the learned counsel is unable to put forth the stand of the Petitioner. Hence, learned counsel for the Petitioner submitted that, the Court may take any decision in this matter.

Taking note of the said submissions and, as the reasons assigned by the Petitioner for transfer of the proceedings, are not genuine, this Transfer Civil Miscellaneous Petition stands dismissed.

No costs.
