The petitioner apprehend arrest at the hands of the respondent police for the alleged offence under Section 420 of IPC, Section 4 of Prevention of prize Chit and money circulatin scheme banking Act 1978 r/w Section 34 of IPC in Crime No.10/2014 and seek anticipatory bail. 2.This is second Anticipatory Bail application. The petitioner is a Police Constable and he is running an Unregistered Chit alongwith his wife Sabitha.

3.Since this Court is not inclined to allow this petition, the learned Counsel for the petitioner seeks permission of this Court to withdraw the petition.

4.Hence, this petition is dismissed as withdrawn. 09.06.2015 dn

At this juncture, the learned Counsel for the petitioner submits that the first accused is aged about 80 years old and therefore, petitioner's presence before the Trial Court, could be dispensed with. 2.Accepting the submission of the learned Counsel for the petitioner, this Court directs the first accused to appear before the Trial Court for receiving complaint under Section 207 of Cr.P.C. for questioning, under Section 313 of Cr.P.C, on the day of passing judgment. On the other dates, the petitioner shall file a petition, undertaking that his counsel will cross examine the witness.

3. This Criminal Original Petition is dismissed with the above direction. Consequently, connected miscellaneous petition is also closed. No costs.
