Petition filed under Article 226 of the Constitution of India for the issuance of a writ of mandamus, directing the respondents 1 to 6 to consider the petitioner's representation dated 29.09.2015 and consequently direct the second respondent to reject the application submitted by the respondents 7 and 8. ORDER
By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner, being an agriculturist, gave an objection on 01.10.2014, along with others, objecting to the proposal of laying a pipe line affecting their rights through the cart track situated in S.F.No.999 in Ponnalamman Solai Village, Dhali Town Panchayat, Udumalpet Taluk, Tiruppur District. Such objection was also given by the Tamilnadu Agricultural Association on 26.03.2015. It was followed by another representation of the petitioner, dated 29.09.2015, made to the second respondent. Despite the same, no action is forthcoming. Hence, the present writ petition has been filed.
3. Considering the above and without going into the merits of the case, a direction is issued to the second respondent, to pass appropriate orders on the pending representation of the petitioner, dated 29.09.2015, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner as well as to the seventh and eighth respondents
4. With the above direction, this writ petition is disposed of. No costs.
