.. Respondents Prayer:Petition filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus directing the respondents to close or shift the Shop No.2251 at No.34, Gothandaraman Street, Gandhi Maidanam, Mettupalayam.

ORDER

Heard Mr.A.Tamilvanan, learned counsel for the petitioner ; Mr.S.Diwakar, learned Special Government Pleader appearing for the 1st respondent and Mr.B.Nedunchezhiyan, learned counsel appearing for the respondents 2 and 3 with their consent, the Writ Petition itself is taken up for final disposal.

2.The petitioner has filed this writ petition praying for a direction upon the respondents to consider his representation and thereby close the TASMAC retail vending shop No. 2251 at No.34, https://hcservices.ecourts.gov.in/hcservices/

Gothandaraman Street, Gandhi Maidanam, Mettupalayam, or to shift the said shop to some other place.

3.Several averments have been set out in the representation to justify the petitioner's request as to why the shop should be closed or shifted.

4.The District Manager of TASMAC, the 4th respondent has filed a counter affidavit saying that all is well and there is no disturbance to anybody on account of the said shop. In any event, since the writ petition is pending before this Court since 2013 onwards and no useful purpose would be served, to keep it pending any further, there will be a direction to the 1st respondent to depute one of his senior official to cause an inspection of the shop in question and file a report to the 1st respondent and based on such report, the 1st respondent shall act in accordance with law. 5.The Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
