The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 417 of IPC in Crime No.12 of 2022, seeks anticipatory bail.

2. Heard both sides.

3. The case of the prosecution is that the petitioner fell in love with the victim/defacto complainant. On the pretext of marriage, the petitioner had penetrative sexual assault on the victim and thereafter he refused to marry her. Hence, the complaint.

4. In fact, the matter has been referred to mediation for amicable settlement but there is no settlement arrived between the parties. On the pretext of marriage, he had penetrative sexual assault on the victim and thereafter, he had refused to marry her and cheated.

5. Considering the above facts and circumstances of the case, the petitioner had committed a very serious and heinous offence as against the victim and as custodial interrogation of the petitioner is very much required, this Court is not inclined to grant anticipatory bail to the petitioner.
