ORDER

This Criminal Original Petition is filed to direct the respondent police to register the complaint of the petitioner dated 24.11.2015, to investigate the same and to file final report before the appropriate court, in accordance with law, within a stipulated time.

2. I have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents and I have also perused the records carefully.

3. It is represented by the learned Additional Public Prosecutor that the complaint was given by the petitioner to the Commissioner of Police and the same has been forwarded to the 2nd respondent for enquiry. He further submitted that the petitioner is not co-operating with the enquriy.

4. Under such circumstances, the petitioner is directed to appear before the 2nd respondent and co-operate with the enquiry and the 2nd respondent is directed to expeditiously conduct enquiry and in the course of enquiry, if cognizable offence is made out, the respondent is directed to act in accordance with the law laid https://hcservices.ecourts.gov.in/hcservices/

down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)]. On the other hand, if no cognizable offence is made out and the dispute is civil in nature, the same shall be closed and a copy of the closure report shall be furnished to the petitioner.

This Criminal Original Petition is disposed of with the above direction.
