Respondent Prayer : This Writ Petition is filed under Article 226 of the Constitution of India, by transfer of OA.No.6450 of 2002 from the file of the Tamil Nadu Administrative Tribunal, to issue a Writ of Mandamus to direct the Respondent to include the name of the Petitioner in the ensuing panel of qualified Field Surveyors for promotion as Firka Surveyors in the appropriate place in the order of seniority and to promote him as Firka Surveyor, consequent on such inclusion or to promote him temporarily as Firka Surveyor under Rule 39(a)(i) or (d) of the Tamil Nadu State and Subordinate Service General Rules in the order of seniority without reference to the disciplinary proceedings initiated against the Petitioner by the Respondent in Na.Ka.No.a7/16883/97, dated 3.10.2000.

ORDER

The learned Additional Government Pleader for the Respondent, on instructions, has submitted that the punishment imposed on the Petitioner has been implemented and thereafter, he has been reinstated from 24.06.2008, but however, such a punishment imposed on the Petitioner would not affect the promotion of the Petitioner and hence, nothing survives in this Writ Petition and also filed a memo to that effect.
