PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, calling for the entire records pertaining to the Letter No.f/vz;/,/ep/bgh-,/g/mdif-vg;/fhk;/vz;/631-10 dated 26.09.2010 issued by the 3rd respondent and quash the same and direct the 3rd respondent to remove all the E.B. Pillar posts erected in the Petitioner's property and take back the equipments from the said petitioner's property.

2. The order impugned was issued based on the complaint given by the petitioner. The learned counsel appearing on behalf of the respondent Tamilnadu Electricity Board made a submission that a civil suit is now pending before the learned Munsif Court in O.S.No.837 of 2008. Thus, the case of the petitioner is to be considered only after reaching finality in the civil dispute raised between the parties.

3.Under these circumstances, the petitioner is at liberty to approach the competent Authorities of the Electricity Board, after realization of their rights in the civil dispute raised between the parties.

4.With these observations, this Writ Petition stands disposed of. No costs.
