PRAYER: This Criminal Original Petition is filed under Section 482 of Code of Criminal Procedure to issue appropriate direction to the respondent not to harass the petitioners by compelling them to pay the amount claimed by M/s. Magha Infra Development Private Ltd., Hyderabad without resolving the dispute through a Civil Forum or Arbitration as per Clause (IV)(b) of the Load Agreement dated 18-05-2012 between M/s.PGC Textile Corporation Pvt.Ltd., Tirupur and M/s. Magha Infra Development Private Ltd., Hyderabad.

ORDER

This criminal original petition has been filed seeking a direction to the respondent police not to harass the petitioners by compelling them to pay the amount claimed by M/s. Magha Infra Development Private Ltd., Hyderabad without resolving the dispute through a Civil Forum or Arbitration as per Clause (IV)(b) of the Load Agreement dated 18-05-2012 between M/s.PGC Textile Corporation Pvt.Ltd., Tirupur and M/s. Magha Infra Development Private Ltd., Hyderabad.

2. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.

3. It is submitted by the learned Additional Public Prosecutor that the petitioners are not required for the enquiry.

Recording the same, the criminal original petition is closed and the petitioners shall not be unnecessarily harassed unless, they are involved in any other cognizable offence.
