Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Certiorarified Mandamus calling for the records of the impugned order passed by the first respondent in AIR(SA) 56 of 2023 dated 19.05.2023 and quash the same and consequently, direct the first respondent to reconsider the application filed by the petitioner in AIR(SA) 56 of 2023 on merits after determining the method of computing the pre-deposit amount for the purpose of the application.

ORDER

(Made by the Hon'ble Chief Justice) Learned counsel for the petitioner, on instructions, submits that the petitioner would deposit the amount as directed by Debt Recovery Appellate Tribunal in the impugned order.

2. In view of that, we are not inclined to entertain the writ petition. The petitioner may deposit the amount within eight days, as directed by the Debt Recovery Appellate Tribunal.

3. The writ petition is disposed of. There will be no order as to costs.
