ORDER
Seeking a direction to the first respondent police to register a case on the complaint dated 08.03.2015 on his file given by the petitioner herein against the 2nd respondent, the petitioner has come up with this petition.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent police.
3. The allegation of the complaint is that the opposite party is unnecessarily pressing the calling bell button of his house and causing annoyance. In this regard, it is also alleged that the opposite party is sending abusive messages through SMS. But the petitioner has not even stated what are the abusive messages in the complaint nor has enclosed any material to show that.
4. Under such circumstances, this Criminal Original Petition is closed giving liberty to the petitioner to approach the first respondent police with a fresh complaint giving details of the messages and if the complaint discloses the commission of any cognizable offence, the first respondent police shall take action https://hcservices.ecourts.gov.in/hcservices/
in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)]..
