The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 of IPC in Crime No.406 of 2023, seeks anticipatory bail.
2.The case of the prosecution is that on 17.11.2019 the defacto complainant approached the petitioner's construction company and the landlord, based on the advertisement, for purchase the apartment at Ashok Nagar, Chennai made a construction agreement on 15.11.2019, for that purpose the defacto complainant made the payment to the petitioner's bank account vide through the RTGS and Cheque of nearly Rs.50,00,000/- on different occasions. Thereafter, the petitioner deceived the defacto complainant without taking steps to construction. Further they had threatened the defacto complainant. Hence the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and falsely implicated in this case. She is a law abiding citizen 1/5
and ready to abide by any condition that may be imposed on her by this Court. She is ready to furnish substantial sureties for her release. Hence, he prays to grant anticipatory bail to the petitioner.
4.The learned Government Advocate (Crl.Side) appearing for the respondent vehemently opposed to grant anticipatory bail to the petitioner. The petitioner herein is the wife of A1 and she also conspired with A1 and cheated the defacto complainant to a tune of Rs.80,00,000/-. A1 is running a construction company and the petitioner is the proprietor of the construction company. No recovery has been made.
5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and perused the entire materials available on record.
6.Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side) and considering the gravity of the offence and also taking note of the fact that the case is at initial stage and it needs detailed investigation. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. 2/5
