ORDER

This criminal original petition has been filed seeking a direction to the respondent to register an FIR on the basis of the complaint of the petitioner dated 26.07.2016.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. It is seen that the petitioner lodged a complaint dated 13.05.2016, based on which, petition enquiry was conducted in CSR No.298 of 2016 and the same was closed on 20.05.2016. Thereafter, the petitioner, further, has given a complaint dated 26.07.2016 referring to pendency of a suit in O.S.No.587 of 2014 between the parties. The second complaint does not disclose any commission of cognizable offence for the police to register an FIR.

4. Hence, no positive direction can be given to the respondent police to register an FIR on the complaint dated 26.07.2016 given by the petitioner. A copy of the Closure Report has been furnished to the learned counsel for the petitioner, in connection with CSR.No.298 of 2016, across the bar.

Recording the same, this criminal original petition is closed with liberty to the petitioner to workout his remedy in the manner known to law.
