This petition has been filed to direct the learned Special Metropolitan Magistrate, Special Court for Exclusive Trial of Land Grabbing Cases-I, Chennai 600 003 to take cognizance of offences mentioned in the final report in Cr.No.658 of 2010 dated 27.12.2010 filed by the second respondent against the accused persons in accordance with law.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.
3. On the complaint given by the petitioner, the respondent police registered a case in Cr.No.658 of 2010 and after completing the investigation has filed a Final Report on https://hcservices.ecourts.gov.in/hcservices/
03.10.2015 before the Special Metropolitan Magistrate, Special Court for Exclusive Trial of Land Grabbing Cases-I, Chennai-3. But in view of the stay granted by the Supreme Court in the connected matters, the learned Special Metropolitan Magistrate is not taking the case on file.
4. In view of the above, this Court directs the learned Special Metropolitan Magistrate, Special Court for Exclusive Trial of Land Grabbing Cases-I to transfer the Final Report and connected papers in Cr.No.658 of 2010 to the newly constituted Court of the Magistrate for Central Crime Branch cases within a period of two weeks from the date of receipt of a copy of this order. Thereafter, the learned Magistrate shall take the transferred case on file and proceed in accordance with law. With the above direction, this petition is closed.
