This Second Appeal filed under Section. 100 of C.P.C. against the judgment and decree passed in A.S.No. 56 of 2013 on the file of the Principal District Judge, Erode dated 22.10.2013 confirming the judgment and decree passed in O.S.No. 340 of 2006 on the file of the Learned II Additional Sub-Ordinate Judge, Erode dated 09.11.2012.

2. The learned counsel appearing for the appellants would submit that the notice sent to the first appellant seeking instruction was returned as refused. The other appellants though have received the notice had not responded. Hence, she reports no instructions. Accordingly, this appeal is dismissed for non-prosecution. Consequently, connected miscellaneous petition is closed.
