ORDER

The writ petition is filed seeking a mandamus directing the respondent herein to refer the matter for enhancement of compensation for the acquired lands measuring 0.11.05 hectares comprised in S.F. No. 33/4/ B situated at Kheezhanur, Thirunallur and Pettai Revenue Village, Karaikal District under Section 18 of the Land acquisition act, 1894 within a stipulated period and pass such further or other orders.

The learned Counsel for the petitioner would submit that the petitioner is the absolute owner of the subject land comprised in S.F.No.33/4/B measuring 0.11.05 hectares situated at Kheezhanur, Thirunallur and Pettai Revenue Village, Karaikal. He would further submit that the subject lands were acquired for the purpose of development of Temple Town Thirunallar (Ring Road and Facility Node) under the provisions of Land Acquisition Act, 1894 and thereafter, an award was passed vide order dated 07.10.2010, directing the petitioner to receive a sum of Rs.8,92,265/- as compensation for the lands acquired. He would further submit that the petitioner made an application dated 03.02.2011, seeking enhancement of compensation at Rs.

25,000/- per 'Kuzhi' and also requested the respondent to refer the matter to Civil Court for fixing just compensation under Section 18 of the Land Acquisition Act and the same was kept pending. He would further submit that the petitioner submitted a representation dated 05.01.2023, requesting the respondent to refer the matter to Civil Court and the same was not considered as on date. Hence this writ petition.

The learned Additional Government Pleader (Puducherry) appearing for the respondent would submit that the petitioner's representation dated 05.01.2023 will be considered within a period of 12 weeks.

Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the respondent to dispose of the petitioner's representation dated 05.01.2023, on merits and in accordance with law, within a period of twelve

(12) weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition stands disposed of. No costs.
