These petitions have been filed seeking to condone the delay of 318 days in filing petition to set aside abatement consequent to the death of the 8 th respondent, to set aside abatement and to bring on record her legal representatives of the deceased 8 th respondent / Sarojini as respondents 17 to 19. 2.In the affidavit filed in support of these petitions, it had been contended that the legal representatives had already been brought on record in the connected appeal suits. These applications have now been filed in the cross objection preferred.
3.Heard the learned counsel who had earlier entered appearance for Sarojini who stated that he would also take notice for the proposed respondents.
4.In view of the fact that the appeals arise from the suit for partition and all the legal heirs are required to be heard before taking any decision, these petitions are allowed.
