(Order of the Court was made by The Hon'ble Chief Justice) A perusal of the petition and the documents show that the petitioner had earlier filed W.P.No.15625 of 2015 in which directions were passed on 04.06.2015. The petitioner alleged non-compliance by the respondents of removal of encroachments and filed Contempt Petition No.1912 of 2015, but the contempt petition has been closed on 18.09.2015 satisfied that the needful has been done.
2.Learned counsel for the petitioner now seeks to contend that there have been re-encroachments as alleged in the petition. The communications and representations sent by the petitioner, however, show that there is once again an endeavour to re-agitate the issue that the manner of removal of encroachments earlier in pursuance to the orders passed on 04.06.2015 were not satisfactory, but that plea has been examined in the contempt proceedings and the contempt proceedings have been closed.
3.All that can be said is that there is a single line averment about re-encroachment.
4.We are sure that if any re-encroachment occurs, the respondents do care to see that the endeavour of removal of encroachments is not frustrated by any re-encroachment. 5.Writ petition, accordingly, stands closed.
