ORDER
This Criminal Miscellaneous Petition has been filed praying to suspend the sentence imposed in CC.No.110 of 2020 dated 28.03.2025 on the file of the IInd Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai-104 and to enlarge the petitioner on bail pending disposal of the above appeal.

The case of the prosecution is that the accused were found in possession of 23 kg of 'ganja'. The petitioner, who is the first accused in CC.No.110 of 2020, was convicted and sentenced by the IInd Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai-104, vide judgment dated 28.03.2025, as follows:
Rank of the accused Conviction under Section Sentence awarded to undergo rigorous imprisonment for a period of 10 years and to pay fine of Rs.1,00,000/-, in default to undergo simple imprisonment for three months 3.
Heard the learned counsel for the petitioner and the learned A1 Section 8(c) r/w 20(b)(ii)(C) of NDPS Act Additional Public Prosecutor for the respondent. 2/4

This Court finds no reasons to suspend the sentence since the Trial Court has gone through the evidence in its entirety and also finds that the petitioner had committed very serious and heinous offence against the society.

In the result, this petition is dismissed.
