ORDER

The marriage between the petitioner and the respondent was solemnised on 01.11.2023 at Sri Bathala Ponniamman Kovil, Purasaivakkam as per Hindu rites and customs. No child was born through the wedlock. The relationship between the parties came under strain. They are living separately since March 2024. The petitioner herein filed HMOP No.213 of 2025 before the Sub Court, Ambathur seeking dissolution of marriage. The respondent also filed HMOP No.1318 of 2025 before the I Additional Family Court, Chennai seeking dissolution of marriage. The petitioner filed this Transfer CMP seeking transfer of the HMOP filed by the respondent to the file of the Sub Court, Ambathur. 2.When the matter was listed before me for admission on 23.05.2025, I felt that the issue can be resolved through mediation. The parties were therefore

directed to be present before the Mediation Centre attached to the Madras High Court. Pursuant to the direction given by me, the parties appeared before the Mediation Centre. As many as three sittings were conducted. The parties arrived at an understanding and a memo of compromise was also filed on 07.07.2025. The Mediation Centre has submitted a report enclosing the said memo of compromise. 3.The parties appeared before me through video conferencing. They have been duly verified by their respective counsel (Ms.R.Sripriya, Enrl No.2608/2013) & A.Manoj Kumar, Enrl No.1068/2011). The parties requested me to transfer both the HMOPs filed by them to the file of this Court and grant decree of divorce in terms of the compromise memo. I am satisfied that the parties have arrived at a settlement without any coercion or inducement.

Exercising jurisdiction and powers under Article 227 of the Constitution of India r/w.Section 13(B) of the Hindu Marriage Act, 1955, this Transfer Civil Miscellaneous Petition is disposed of in the following terms : a) The marriage solemnised between the parties on 01.11.2023 at Sri Bathala Ponniamman Kovil, Purasaivakkam stands dissolved by mutual consent.

b) Thiur.S.Chandrasekhar, the respondent herein has handed over a Demand Draft for a sum of Rs.2.00 lakhs favouring the petitioner herein to his counsel. Thiru.Manojkumar, the learned counsel for the respondent undertakes to hand over the demand draft to the counsel for the petitioner. Ms.Sripriya, the learned counsel for the petitioner in turn will hand over the same to the petitioner Girija. c) The compromise memo dated 07.07.2025 shall form part of this order. Registry is directed to draft a decree in terms of the aforesaid memo.

d) The learned counsel on either side undertake to file memo before the respective courts. Both the HMOPs shall be closed by the courts below by recording this order.

No costs.
