Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 24.5.2023 and consequently, direct the respondents 1 - 5 to take necessary action against the culprits and further direct to take action to cancel the passport of the 6th respondent. O R D E R

When this writ petition was came up for hearing on 10.07.2023, this Court passed the following order:

The respondents 1 to 3 are not necessary parties in this writ petition and hence, they are deleted from the array of respondents. The learned Additional Public Prosecutor takes notice on behalf of 4th respondent.

2.It is seen from records that the Court below has not accepted the closure report as against A2 and the Court below has taken cognizance of the offence as against all the accused persons numbering seven. The grievance of the petitioner is that no effective steps have been taken to issue the process on the accused persons for their appearance before the Court. It is further brought to the notice of this Court that the case is now posted on 09.08.2023 for the appearance of the accused persons. 3.Post this case under the caption "for orders" on 07.08.2023. In the meantime, the 4th respondent shall ensure that the process is served on all the accused persons and they should appear before the Trial Court on the date of hearing. The report shall be filed in this regard during the next date of hearing.

2.When the matter was taken up for hearing today, the learned Government Government Advocate (Crl.side) submitted that all the accused persons have been served with summons and the matter now stands posted for framing charges on 27.09.2023, before the Court below. 3.In the light of the above submission, the Court below shall proceed further with the case in accordance with law. 4.This writ petition is disposed of accordingly.
