TERMS OF SETTLEMENT The appellant / Insurance company agreed by the Lower Court award preferred the appeal in 2008 and the same is still pending. After perusal of the record or otherwise the Insurance company felt prosecuting the appeal may not be serve ethical purpose and they do not want to prosecute the appeal and for the same, they have filed a memo not pressing the appeal, permitted them to withdraw. Permitted.
2.The appeal is dismissed as withdrawn, since by withdrawal of this appeal no prejudice caused to other side. Notice not ordered. Consequently, connected Miscellaneous Petition is closed, if any.
