ORDER

Seeking a direction to the respondents to register a case based on the complaint dated 09.03.2014 and to proceed further in accordance with law, the petitioner has come up with this petition. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents and perused the material placed on record.

3.It is the allegation of the petitioner that his neighbour has borrowed money from Tamil Nadu Industrial Investment Commission (TIIC) and mortgaged his property. The neighbour of the petitioner had defaulted in payment of dues to the Tamil Nadu Industrial Investment Commission and therefore, the neighbour's property was brought for sale. portion of the petitioner's property appears to be included in the sale. Aggrieved by which, the petitioner has approached the Tamil Nadu Industrial Investment Commission not to usurp his property. Hence, the respondent police is directed to conduct enquiry and during the course of enquiry, if any congnizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh & Others reported in (2014) 2 SCC 1. With the above direction, this Criminal Original Petition is closed.
