The petitioners, who are arrayed as accused in Crime No.144 of 2022 for the offences punishable under Sections 489-B and 489-C of IPC, have filed this Criminal Original Petition seeking to quash the FIR.
2. The learned counsel for the petitioners submitted that the offences alleged under Sections 489-B and 489-C of IPC are not attracted, as the petitioners were neither involved in the use nor trafficking of counterfeit currency notes. It was further contended that no counterfeit currency was recovered from the petitioners.
3. The learned counsel for the petitioner further submitted that there was previous enmity between the petitioner and the defacto complainant and hence a false case has been lodged alleging that the petitioner had placed counterfeit currency notes in the shop of the defacto complainant. 4. The learned Government Advocate (Crl. Side) submitted that the FIR has been registered in 2022 and the investigation is still in progress. He submitted that no CCTV footages were collected. He further submitted that five currency notes of Rs.500/- denomination were seized and sent for forensic examination and that the forensic report is still awaited.
