Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the first respondent to take necessary action on the representation dated 29.04.2016 sent by the petitioner by directing the concerned respondent to take necessary action. By consent, this Writ Petition is taken up for final disposal.
2. The petitioner claims that she is a widow having two children and working as house maid and eking out her livelihood and she was allotted Plot bearing No.627, 4th Block, Kesavapillai Park, Demellos Road, Puliyanthope, Chennai-600 012. The petitioner has also shifted to the said premises and when the petitioner went there, she found that the said premises was locked and was informed that one John @ John Peter/sixth respondent, S/o.Abraham, residing at No.2/3, Asairvatha Puram, 2nd street, Pulianthope, Chennai-12, is residing there and has locked the premises. According to the petitioner, the said person is working in Rajiv Gandhi Government General Hospital and also indulging in money lending business and in this regard, the petitioner has also lodged a compliant to the jurisdictional police and though it was received and entertained by the police on 08.01.2016, no action has been taken. The petitioner, expressing her grievance, has submitted a detailed representation to the first respondent and since no orders have been passed, came forward with this writ petition.
3. Heard the submissions of the learned counsel appearing for the petitioner and Mr.D.Latha, learned Standing Counsel for the respondents 1 to 5, who on instructions would submit that the petitioner, subject to fulfillment of norms, will also be given alternative accommodation in a nearby place.
4. Mr.S.Vijay Kanth, learned counsel appearing for the sixth respondent would submit that the sixth respondent has been given permanent allotment and therefore, the claim of the petitioner is wholly unsustainable.
5. This Court, in the light of the above facts and circumstances and without going into the merits of the same, directs the first respondent to consider and dispose of the petitioner's representation dated 29.04.2016 on merits and in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
