C.M.P.No.17947 of 2021 in Rev.Appl.No.81138 of 2011 P.T.Asha, J.

The above petition is filed to condone the delay of 3082 days in representing the papers in the above review petition.

2. In the affidavit filed in support of the petition, the petitioner has narrated the reasons as to why the delay had occasioned.

3. The learned counsel for the petitioner would submit that the connected Second Appeal in S.A.No.1801 of 1997 is pending before this Court and listed today.

4. A perusal of the plaint in both the matters, namely, O.S.No.146 & 147 of 1988 would indicate that although the schedule of properties shows different numbers however, the four boundaries that have been given is identical.

5. The learned counsel for the respondents objected the above condone petition being allowed. However, taking into consideration the fact that the review petition has been filed in time and as the issue in both the appeals have bearing on each other the delay is condoned.
