PRAYER:

Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondents 1 to 3 to take action under Sec.196 and 197 of the Chennai City Municipal Corporation Act, 1919 to remove the debris stored by the 4th respondent in the terrace portion of Shop No.C & D in the premises bearing old D.No.25 and new No.43, Arcot Road, Kodambakkam, Chennai -24 under occupation of the petitioners.

ORDER

Heard the learned counsel for the petitioners, learned Standing Counsel for the respondents 1 to 3 and the learned counsel for the fourth respondent and perused the materials available on record.

2. The petitioners have come forward with this petition for issuance of Writ of Mandamus to direct the respondents 1 to 3 to take action under Sections 196 and 197 of the Chennai City Municipal Corporation Act to remove the debris stored by the 4th respondent in the terrace portion of Shop Nos.C & D in the premises bearing old D.No.25 and new No.43 at Arcot Road, Kodambakkam, Chennai.

3. It is represented by the learned counsel for the petitioners that the debris stored in the terrace portion of the demised building have now been removed.

4. In the light of the above submission, this Court is of the opinion that no further adjudication is required in this writ petition. Hence, the writ petition is closed. No costs.
