This petition has been filed to direct the respondent not to harrass the petitioner.
2. Heard the learned counsel for the petitioner; learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.
3. It is seen that this petitioner was married to one Samuel Dinakar and on account of the matrimonial discord, she left her husband and settled in Coimbatore with her son. Samuel Dinakar gave a compliant to the respondent Police, based on which, a case in Crime No.2726 of 2016 for woman missing was registered on 30.06.2016 and during the course of enquiry, Elizabeth appeared before the respondent Police and the case was closed as mistake of fact on 04.08.2016. Now, once again, Elizabeth's brother John has given a complaint of woman missing to the Deputy Commissioner, Mount, based on which, the petitioner is being unnecessarily calling for enquiry.
4. If the Police wants to conduct further enquiry, liberty is given to them to issue summons to the petitioner under Section 160 Cr.P.C. in accordance with law and not simply call the petitioner and harass her.
