The petitioner/accused, who was arrested and remanded to judicial custody on 22.04.2025, for the alleged offences punishable under Sections 126(2), 296(b), 311, 351(3) of BNS Act (341, 294, 397, 506 of IPC), in Crime No.213 of 2025, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 22.04.2025, the petitioner along with other accused waylaid the defacto complainant and abused him in filthy language and robbed Rs.500/- from him at knife point. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would submit that the petitioner has been in judicial custody from 22.04.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate for the respondent submitted that the petitioner along with the other accused waylaid the defacto complainant and abused him in filthy language and robbed Rs.500/- from 2/4

him at knife point. He further submitted that the petitioner is a habitual offender and that there are eight previous cases against the him. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the fact that the petitioner is a habitual offender and the offences charged against him are grievous in nature, I am not inclined to grant bail to the petitioner herein. Hence, the Criminal Original Petition stands dismissed.
