The petitioner, who was arrested and remanded to judicial custody on 31.05.2022 for the offences punishable under Sections 363 and 366 of IPC @ 363, 366 r/w 9 of Child Marriage Act and 5(I) r/w 6 of Protection of Children from Sexual Offence Act in crime No. 6 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner herein under the pretext of marriage had kidnapped the victim girl aged 17 years. Hence, the complaint.
3. The victim girl is 17 1⁄2 years only. In the pretext of love affair and also marriage, the petitioner had committed penetrative sexual assault on the victim girl aged about 17 1⁄2 years. It is also confirmed from the statement recorded under Section 164 of Cr.P.C. Further, it reveals that on his compulsion, she was kidnapped by the petitioner and was sexually assaulted.
