Petition under Article 226 of the Constitution of India praying for issue of Writ of Mandamus to direct the 1st respondent to consider the Members dated 03.01.2015 in the light of the G.O. (Ms.) No.186, dated 11.12.2001 issued by the 1st respondent department.

O R D E R

(Order of the Court was made by The Hon'ble Chief Justice) On perusal of G.O. (Ms.) No.186, Animal Husbandry and Fisheries Development (AH 2) Department, dated 11.12.2001, it transpires that the land has not been transferred to any one, but has been designated for purposes of cattle grazing. In terms of the said G.O., this land cannot be used for any purpose other than grazing and if the land is required by any other department, then twice that amount of land has to be made available for cattle grazing. The Controlling Authority is the District Collector. 2.The petitioner has neither made a representation to the District Collector nor has he impleaded the District Collector as a party in this petition.

3.In view of the aforesaid position, learned counsel for the petitioner seeks to withdraw the petition with liberty to approach the District Collector, Coimbatore District and on such representation being made, the District Collector will dispose of the same within one month of receipt of the representation, by a speaking order, after notice to all concerned. A copy of the representation to be made by the petitioner should enclose the order passed by this Court.
