RESPONDENTS Prayer: The Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider the representation dated 19.02.2013 on the basis of direction given by 3rd respondent to the 5th respondent vide Na.ka.17/2015 A 1(2) dated 12.10.2015.

By consent, the writ petition is taken up for final disposal at the admission stage itself.

2. The case of the petitioner is that after serving in the Co-operative Bank for about 38 years, he retired from service on 31.05.2008. At the time of retirement, the petitioner was forced to execute an indemnity bond in respect of cheque misplaced incident happened in the year 2002 and also withheld Rs.25,000/-. The petitioner sent a detailed representation on 16.05.2012 and 19.02.2013 in this regard, but no action was taken so far. Hence, the present writ petition has been filed.

3. Heard Mr.R.Nirmala Devi, learned counsel for the petitioner and Mr.D.Venkatachalam, learned Government Advocate, who accepts notice on behalf of the respondents.

4. This Court, in the light of the above facts and circumstances, permits the petitioner to submit one more representation to the fifth respondent by enclosing a copy of this order as well as copy of the relevant records within a period of two weeks from the date of receipt of a copy of this order. The fifth respondent, on receipt of the same, is directed to consider the said representation on merits and in accordance with law and pass appropriate orders within a period of six weeks therefrom and communicate the decision taken, to the petitioner.

With the above said directions, the writ petition is disposed of. No costs.
