Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the second respondent herein to consider the representation of the petitioner herein dated 06.02.2015 forthwith. For Petitioners :

ORDER

Heard Ms.R.Vinu Priyanga, the learned counsel for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader for the respondents.

2. The petitioner, who is running a small tiffin stall near the North Chennai Registrar's office, has come forward with this petition to direct the second respondent to consider his representation dated 06.02.2015.

In the representation, the petitioner has made allegations against the third respondent as well as the officials of the Corporation of Chennai stating that they are insisting on payment of money to carry on business.

3. It is not known whether the petitioner has obtained any licence from the Corporation or the police authorities before establishing his tiffin shop. If the petitioner does not possess licence, the petitioner is obviously an encroacher on road margin and the authorities are entitled to take action in accordance with law.

4. Accordingly, the writ petition is disposed of giving liberty to the petitioner to obtain appropriate licence from the Corporation of Chennai and police authorities and thereafter, continue his business.
