RESPONDENTS Prayer: The Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents herein to pass final orders on the representation dated 02.11.2015 seeking payment of terminal benefits and pension with interest consequently pay all terminal benefits and pension with interest to the petitioner. By consent, the writ petition is taken up for final disposal at the admission stage itself.
2. According to the petitioner, while he was working as a Village Administrative Officer, at Kandampatti, the third respondent issued a charge memo alleging some irregularities. On 31.08.2006, the petitioner was permitted to retire from service without prejudice to the disciplinary proceedings. Though the enquiry officer submitted his report to the third respondent on 31.01.2007 and despite explanations submitted by the petitioner in the month of August, 2008, the disciplinary Authority has not passed any order. Therefore, he filed a writ petition in W.P.No.21312 of 2010. Despite the order passed by this Court, they have not passed final orders and eventually, on 20.08.2013 a punishment was imposed with holding Rs.750/- per month from his pension for a period of three years.
3. The petitioner would state that he made a representation on 02.11.2015 for payment of his terminal benefits and pension. Since it was not considered, the present writ petition has been filed.
4. Heard Mr.Muthumani Doraisami, learned counsel for the petitioner and Mr.M.L.Mahendran, learned Government Advocate for the respondents.
5. Though the petitioner prayed for a larger relief, this Court, without going into the merits of the case, directs the respondents 1 to 3 to consider the representation of the petitioner dated 02.11.2015 and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
With the above direction, this writ petition is disposed of accordingly. No costs.
