ORDER

Seeking a direction to the 2nd respondent to register a case in pursuant to the complaint dated 19.02.2015 of the petitioner for the offences under Sections 420, 120-B, etc. IPC, the petitioner has come up with this petition.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents and perused the material placed on record.

3.On reading of the complaint, it is seen that about 5 years back, the complainant has given Rs.3,50,000/- to the opposite party for the purchase of the land. It is alleged by the complainant that the opposite party did not sell the land to him https://hcservices.ecourts.gov.in/hcservices/

and did not return Rs.3,50,000/-. Thus, it is essentially a breach of contract and hence, there is no cognizable offence is made out. Hence, this petition is closed, with a liberty to the petitioner to work out his remedies before the civil Court in the manner known to law.
