Comp.A.No.293 of 2020 in C.P.No.7 of 2015 KRISHNAN RAMASAMY, J., This application is filed to direct the petitioner to deposit a sum of Rs.53,000/- which includes Rs.33,000/- incurred towards professional fee plus Rs.20,000/- towards initial deposit that the petitioner was directed to pay in terms of the order of this Court dated 09.09.2015 in C.P.No.7 of 2015.
2. Pending this application, the Company in liquidation has deposited the the expenses amount incurred towards professional fees to the Official Liquidator. Therefore, he submitted that nothing survives for further adjudication in this application.
3. In view of the above submission made by the learned Official Liquidator, this application is dismissed as infructuous.
4. It is further reported that the order dated 09.09.2015 was set aside by the Hon'ble Division Bench of this Court vide, order dated 13.06.2016 and thereafter, a compromise memo was entered into between the parties and the 1/3
Memo was recorded by this Court vide order dated 23.04.2018.
5. However, the learned counsel submitted that till date the Records at ROC Chennai, it appears that as if the company is still in liquidation. The learned Official Liquidator is directed to inform the concerned Registrar of Companies to change the status of the Company as alive instead of in liquidation and the concerned Registrar is also directed to change the status of the Company immediately, upon the receipt of this order. 25.01.2023 ssn 2/3
