The Writ Petition has been filed for directing the respondent to consider the representation dated 10.01.2024 made by the petitioner to treat the period of desertion and out of employment period as leave without pay, but with continuity of service as per Fundamental Rules.
2. The learned Government Advocate appearing for the respondent, on instructions, states that no such representation so far received from the petitioner.
3. On a perusal of the representation dated 10.01.2024 submitted by the petitioner, it is seen that the petitioner sought for the period of desertion and out of employment period as leave without pay, but with continuity of service as per Fundamental Rules.
4. Considering the above facts and circumstances, the petitioner is at liberty to submit a fresh representation to the respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the respondent is directed to dispose of the same after issuance of 2/4
notice to the petitioner and counter parties, if any and after giving opportunity of hearing to them, pass orders on merits and in accordance with law, within a period of twelve weeks thereafter.
5. With the above direction, this writ petition is disposed of. No costs.
